ORDINANCE NO. 83- 45 <br />AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA, PROHIBITING THE <br />SALVAGING OF ITEMS FROM INDIAN RIVER COUNTY TRANSFER <br />STATIONS AND REQUIRING THE POSTING OF NO SALVAGING <br />SIGNS, PROVIDING FOR PENALTIES; INCORPORATION IN CODE; <br />SEVERABILITY; AND EFFECTIVE DATE. <br />WHEREAS, the Board of County Commissioners of Indian <br />River County has recently been put on notice of certain salvaging <br />activities being conducted by members of the general public at the <br />County's various transfer stations, and <br />WHEREAS, it has been determined that such salvaging <br />activities constitute a hazard to those salvaging as well as' -to <br />the members of the general public using the transfer stations for <br />the purposes they were intended. <br />NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER"COUNTY, FLORIDA that: <br />SECTION 1 <br />NO SALVAGING <br />It shall be illegal and subject to the punishment as <br />provided herein for any person or business entity to salvage <br />materials from any of the County owned and operated transfer <br />stations. For the purposes of this ordinance "salvaging" shall <br />mean the removal of any item from, or sorting through items in a <br />transfer station site after they have been deposited for <br />collection and disposal. <br />SECTION 2 <br />DT.T,7AT-71TVL1 <br />Any violation of the provisions of this ordinance shall <br />be subject to punishment by a fine not to exceed FIVE HUNDRED <br />DOLLARS ($500.00), or by imprisonment in County jail, not to <br />exceed sixty (60) days, or by both such fine and imprisonment. <br />Each day a violation continues after the violator has been <br />notified to cease the violation by an agent of the Board of County <br />Commissioners shall constitute a separate offense. <br />CVOMTnM I <br />INCORPORATION IN CODE <br />The provisions of this Ordinance shall be incorporated <br />into the County Code and the word "ordinance" may be changed to <br />-1- <br />DEC 7 1983 <br />
