JAN 4 1984 BOOK �� tw76 <br />WATER SERVICE AGREEMENT <br />THIS AGREEMENT- made and entered into this 16th day <br />of Janu l -N7 , 1984, by and between INDIAN RIVER COUNTY, <br />a political subdivision of the State of Florida, hereinafter <br />referred to as the "County;" and WEST COUNTY UTILITY, INC., a <br />Florida corporation, hereinafter referred to as the <br />"Corporation;" <br />W I T N E S S E T H: <br />WHEREAS, the County now owns, operates, supervises <br />and manages a water system consisting of wells, water treatment <br />plant, pumping and storage facilities, distribution mains, <br />service mains, meters and appurtenances located in Indian River <br />County, Florida; and.. <br />WHEREAS, -the Corporation is an entity consisting of <br />landowners along the State Road 60 corridor from 43rd Avenue to <br />Interstate 95; and <br />WHEREAS, it is the intent and purpose of the County <br />to construct, own, operate, maintain, supervise and manage an <br />.enlarged water distribution system, which will be capable of <br />distributing treated water to certain unincorporated areas of the <br />County by extending a waterline along a proposed route consisting <br />of a path leading from the connection point at 20th Avenue and <br />Oslo Road northward along 43rd Avenue to 8th Street then west on <br />8th Street to Kings Highway then north on Rings Highway to State <br />Road 60 then west on State Road 60 to Interstate 95. This route <br />may be altered upon the advice of the County's consulting <br />engineer, but shall, in any event, supply water to the State Road. <br />60 corridor west of Kings Highway; and <br />WHEREAS, the Corporation has requested. and encouraged <br />the extension of the waterline and services by the County along <br />the State Road 60 corridor and agrees to participate with the <br />County in structuring the funding for the construction of said <br />waterlines. In addition, the Corporation desires to obtain <br />required reservations for waterline capacity and taps which will <br />be allocated to specific properties. <br />NOW, THEREFORE, in consideration of the mutual <br />
