The <br />Commissioners agreed that the County does not want to <br />necessarily accelerate the development of that land. <br />Attorney Brandenburg explained the Board would merely <br />be changing an ordinance setting up current policy, and <br />there would be nothing to prevent future Commissions from <br />changing the ordinance back after the right-of-way is <br />donated. The property owners may have some legal argument <br />at that time about takings, etc., but the Board cannot enter <br />into a contract laying out what the zoning rights on a piece <br />of property are going -to be in the future, particularly when <br />r <br />it is not known how the area is going to be developed. <br />Chairman Scurlock advised anyone in the audience who <br />had questions regarding this matter to contact either <br />Attorney Brandenburg, Administrator Wright or someone on the <br />staff prior to the public hearing on the proposed zoning <br />code amendment. <br />Joseph P. Strazzulla, grove owner, pointed out that <br />because the property owners in that area are donating a <br />substantial amount of land, they need some protection for <br />the future when they are ready to develop that land. <br />Commissioner Bowman interjected the fact that they <br />would be getting a highway. <br />Commissioner Lyons suggested that staff should be <br />authorized to draft an amendment to the ordinance and that <br />more discussion should take place to see how it goes.
