stated that this is borne out by a report of the County <br />Utility inspector as well as experts on their own staff. <br />Intervener White next questioned Mr. Aiello regarding <br />the polishing pond located east of the maintenance building <br />and had him confirm that whatever treatment is done, the <br />liquid goes into the polishing pond. The Intervener then <br />questioned Mr. Aiello as to the,date of the contract <br />Hutchinson Utility Company entered into with The Moorings <br />where it was agreed that the existing plant would be moved, <br />and Mr. Aiello was not certain of the exact date. Intervener <br />White stated that the contract was as of September 25, 1980. <br />Intervener White submitted Intervener's Exhibit #4 - <br />Letter of Intent between Hutchinson Utility Company and The <br />Moorings Development Company, and asked that Mr. Aiello tell <br />a bit of the background as to how this happened to be <br />entered into. <br />Mr. Aiello explained that The Moorings wanted to be <br />very sure that Hutchinson had the capabilities of operating <br />the system, and he believed the intent was to protect <br />themselves and the property owners; they wanted certain <br />assurances that certain things would happen. <br />Intervener White asked what discussion was held at that <br />time about removing the treatment plant to another location, <br />and Mr. Aiello stated there was very little at that time as <br />far as he knew; possibly his partner may have had other <br />discussions. <br />Intervener White referred to the Addendum to the Letter <br />of Intent dated 9/25/80, Item 12, and noted that it states <br />"Hutchinson Utilities will move existing plant during summer <br />of 1981.• Monies supplied from escrow account."
