77 <br />Mr. Mendez did not consider that an engineering <br />question. <br />Attorney Micale announced that concludes the <br />presentation for Hutchinson Utilities. He then stated that <br />he would like to go back to Phase I that was presented this <br />morning and clarify that there is no legal basis for any <br />retroactive adjustment of rates which have been previously <br />put in place and approved by this Board; any adjustment <br />would have to be an adjustment from today on. He noted that <br />this Board would be powerless to make a retroactive <br />adjustment increasing rates to present customers and <br />conversely, it would work the other way also. <br />Intervener White wished to submit for the record <br />Intervener's Exhibit #9 - a copy of the Minutes of the <br />hearing in August of 1981 where the franchise was <br />transferred to Hutchinson Utilities. He noted that a tape <br />of this meeting is also available. He stated that this will <br />show that at the time the franchise was granted and the rate <br />increase, there was not proper information to grant the rate <br />increase that was given. <br />Attorney Micale believed he presented an objection <br />earlier and noted that if there are any misgivings as to the <br />franchise and the rates in it, he believed that rests with <br />the Board. <br />Intervener White offered as Intervener's Exhibit #10 a <br />document showing that the Public Service Commission of the <br />State of Florida has taken a position in regard to contribu- <br />tions in aid of construction. <br />Intervener White then wished to call to the attention <br />of the members of the Commission the historical rate <br />situation encountered in The Moorings.
