Sec.23 (h) <br />Planning & Development D 1 DIS:RMK <br />It is requested that the information herein presented be given <br />formal consideration by the Board of County Commissioners at <br />its regular meeting of February 8, 1984. <br />DESCRIPTION AND CONDITIONS: <br />Several months ago, the Board of County Commissioners directed <br />the staff to review Section 23(h) of the Zoning Code and <br />recommend needed changes. Relating to time limits of approved <br />site plans, Section 23(h) failed to address --several issues <br />associated with the status of approved plans. - Specifically, <br />Section 23(h) did not adequately define commencement of con- <br />struction, did not provide for the suspension or abandonment of <br />construction, and did not adequately establish a procedure for <br />addressing site plan transfers. <br />After review of the existing ordinance and consideration of the <br />objectives to be attained, the staff recommended a major <br />revision of Section 23(h). This proposed ordinance revision <br />was presented to the Planning and Zoning Commission on November <br />10, 1983. At that time, however, there was some question as to <br />the proposed requirements for site plan transfers, so the <br />Commission directed the staff to reconsider that provision _and <br />revise it, if necessary. After further analysis, the staff <br />revised the proposed amendment to Section 23(h) and submitted <br />it to the Planning.and Zoning Commission for review and action. <br />On January 12, 1984, the Commission unanimously approved the <br />proposed ordinance to amend Section 23(h) and recommended <br />adoption of this ordinance to the County Commission. <br />ALTERNATIVES AND ANALYSIS: <br />As recommended, the proposed amendment would define the com- <br />mencement of construction, limit extensions of approved site <br />plans to one twelve (12) month period, define the abandonment <br />-or suspension of construction, and provide for the termination <br />of site plan approval where construction has been abandoned for <br />more than six months. The amendment would also provide for the <br />transfer of site plan approval upon notification given to the <br />staff as to the new owner and the owner's agent. <br />Because of concerns expressed at the Planning and Zoning <br />Commission meeting, the staff has recommended one additional <br />change to the amended version of Section 23(h). This change <br />would exempt large phased developments from the six month <br />suspension or abandonment provision applicable to site plans. <br />Basically, this change allows more than six months of inactivi- <br />ty %to occur between phases of a large development, if the <br />project were approved in that manner. <br />RECOMMENDATION: <br />The staff recommends that the Board of County Commissioners <br />approve the proposed ordinance amending Section 23(h) of the' <br />Zoning Code. <br />21 <br />FEB 8 1984 56 PAGE 92 <br />
