i 1 <br />I <br />to provide uniform administration of the water franchise and <br />wastewater franchise. The term "water franchise" as used herein <br />refers to those rights and obligations set forth in Resolution No. <br />82-59 of the Board of County Commissioners of Indian River County <br />granting to the North Beach Water Company a water utility fran- <br />chise, as amended from time to time. The term "wastewater <br />franchise" as used herein refers to those rights and obligations <br />set forth in Resolution No. 83-108 granting to Bayside Utilities a <br />wastewater system franchise, as amended from time to time. This <br />agreement is further an accommodation to the Baytree development <br />and the Town of Indian River Shores to promote the efficient pro- <br />vision of water and wastewater services to the annexed property. <br />This agreement shall not in any event be considered authority for <br />further service by the North Beach Water Company or Bayside <br />Utilities into adjacent properties within the Town limits. <br />3. The Town recognizes, accepts and agrees to th.e <br />continued existence of the North Beach Water Company's franchise <br />and the Bayside Utilities wastewater franchise extending within <br />their municipal limits.- The Town further agrees that Indian River <br />County shall have the total and complete authority to administer <br />and regulate the North Beach Water Company franchise and the <br />Bayside Utilities wastewater franchise as they currently exists or <br />as it may be amended in the future by the County with respect to <br />the annexed property. <br />4. The Town agrees that all revenues accruing to Indian <br />River County pursuant to Resolution No. 82-59 and Resolution No. <br />8-3-108 shall continue to accrue to Indian River County and the <br />Town shall have absolutely no right thereto. <br />5. The Town agrees to grant to the North Beach Water <br />Company and Bayside Utilities such right-of-way permits as are <br />necessary for the completion of the project and efficient serving <br />of the annexed property pursuant to the franchise resolution. <br />6. County agrees to continue the administration and <br />regulation of the North Beach Water Company pursuant to Resolution <br />No. 82-59 within the municipal boundaries of the Town to the <br />extent of the annexation.
