Commissioner Wodtke inquired about the statement that <br />there will be a contract to be signed by the Chairman and <br />wished to know what kind of obligation that would put'on us. <br />Attorney Brandenburg explained that this is a require- <br />ment of the new Subdivision Ordinance - all subdivisions <br />which receive final plat approval prior to the improvements <br />being made are required to execute this standard form <br />agreement.' The irrevocable letter of credit then guarantees <br />their performance under the agreement. If they violate the <br />agreement, we call in the Letter and we make the <br />improvements. The contract sets out our responsibilities, <br />and they are only to the extent of the funds available. <br />ON MOTION by Commissioner Lyons, SECONDED <br />by Commissioner Bird, the Board unanimously <br />granted final plat approval to Seagrove West <br />Subdivision subject to a contract binding the <br />applicants to complete all on-site improvements <br />being signed by both the applicant and the <br />Chairman. <br />(Contract, Cash Deposit and Escrow Agreement will be made <br />a part of the record when fully executed and received.) <br />G. Contract for Rourid Island Park Boat Ramp acid Daybeacons <br />OMB Director Barton reported that funds are being <br />provided out of the State Boating Funds for the boating <br />improvements at both Round Island Park and Sebastian Yacht <br />Club. Since these funds are not anticipated in the budget, <br />we need budget amendments to allocate these funds.
