Commissioner Bowman felt it would not get grubbed out <br />if we have a policy and stick to it. She cited the example <br />of the oaks at Riverside Theater where all the understory <br />was cut out leaving the oaks in lonely splendor and felt it <br />would have been much nicer if we had saved an area around <br />the base of the trees. She felt that if we don't take a <br />firm stand, it is never going to be any better. <br />Commissioner Bowman stated that she did not have any <br />objections to the proposed amendment if the understory is <br />still protected under the Ordinance, and Attorney <br />Brandenburg assured her it was. <br />Chairman Scurlock opened the Public Hearing and asked <br />if anyone wished to be heard in this matter. There were <br />none. <br />ON MOTION by Commissioner Bird, <br />SECONDED by Commissioner Wodtke, the Board <br />unanimously closed the -Public Hearing. <br />ON MOTION by Commissioner Bird, <br />SECONDED by Commissioner Lyons, the Board <br />unanimously adopted Ordinance 84-09, amending <br />Sections 8 B (2) (a) and 11 A (5) of Ordinance <br />83-41, known as the Tree Protection Ordinance, <br />providing for the availability of a land clearing <br />and grubbing permit for a property proposed for <br />development prior to the receipt of site plan or <br />subdivision approval. <br />20 <br />But 5- PA.
