into a trust fund to be appropriated by the Board for <br />maintenance and improvements to the court facilities in the <br />County. The County Attorney advised that there does not <br />appear to be any problems with the ordinance and recommended- <br />its <br />ecommended <br />its adoption. He also requested that the Finance Department <br />be instructed to set up the appropriate trust fund. <br />Commissioner Lyons asked about the definition of <br />"maintenance" in regard to the court facilities; is it a <br />common word meaning janitorial services, etc. Attorney <br />Brandenburg explained that this is statutory language <br />meaning maintenance to the capital facility itself, i.e. <br />painting the walls, installing carpeting, etc. <br />Attorney Brandenburg noted that this is an additional <br />fee that the County has not imposed in the past and it will <br />raise the fees required for filing court actions by a <br />considerable amount. This., however, will bring Indian River <br />County in line with fees that are charged in -similar <br />surrounding counties. <br />Attorney Brandenburg reported that OMB Director Jeff <br />Barton estimated the revenue from these fees would run <br />$30,000-$50,000 a year, depending on the activity in the <br />court system. The funds will go into a special court <br />facility fee trust fund and be kept in there year to year; <br />they can only be appropriated by the Board for maintenance <br />and improvements to the court facilities. This fund cannot <br />be used for any other item, and it is not rolled over into <br />the Board's General Fund for the next year. <br />Commissioner Wodtke asked if the funds could be <br />utilized to replace taxpayers' funds that are budgeted for <br />the annual maintenance of the court -facilities. Attorney <br />Brandenburg advised that these funds can be used to cover <br />the normal operational costs of the court facilities; <br />however, the judges and the Bar Association strongly <br />recommend that the funds be used to make necessary <br />40 <br />MAR 14 1984Qa�c <br />56 Pace3 <br />
