Meeks <br />• Staff Planner REFERENCES: DIS : KAREN <br />It is requested that the data <br />consideration by the Board <br />regular meeting of March 21, <br />DESCRIPTION AND CONDITIONS: <br />herein presented be given formal <br />of County Commissioners at their - <br />1984. <br />On December 5, 1983, Ronald Meeks submitted a right-of-way <br />abandonment petition to.the Planning and Development Division. <br />The petition requests that the County abandon .its 'rights to <br />that portion of 5th Street lying west of 38th Avenue within <br />Unit 1 of Cleemann Estates Subdivision. . <br />In accordance with the administrative guidelines approved by <br />the Board of County Commissioners for the processing of right - <br />of -way abandonment applications, the request was reviewed by <br />all County divisions and utility providers having jurisdiction <br />within the roadway. Florida Power & Light and Southern Bell <br />approved the request with the condition that the County retain <br />two 10 foot wide utility easements. The easements will be <br />established at the western and the northern 10 feet of the <br />right-of-way proposed for abandonment. All County divisions <br />contacted approved the request. <br />ANALYSIS: <br />Ronald Meeks owns the 2 lots immediately north of and the 2 <br />lots immediately south of the 5th Street right-of-way. The <br />petitioner desires the abandonment in order to connect the 4 <br />lots and develop the property as one parcel. Southern Bell <br />currently has underground cable along the north right-of-way of <br />5th Street and approved the request with the condition that Mr. <br />Meeks agree to incur the cost of stringing the cable overhead. <br />Maintenance of, the overhead cable is the reason for the <br />establishment of the 10 foot easement along the northern edge <br />of the right-of-way. The petitioner has agreed to the condi- <br />tional approval of Southern Bell. <br />The 70 foot wide right-of-way was dedicated to the County on a <br />plat recorded in 1953 and has not been utilized to this date. <br />Stub -outs, such as this portion of 5th Street, are created to <br />provide for future interconnection with adjacent land parcels. <br />However, in March of 1981, Bentwood Terrace was platted for <br />development on the adjacent parcel and designed with a single <br />cul-de-sac, thereby eliminating the need for the 5th Street <br />stub -out. <br />11 <br />Box 56 PnEE'456 <br />
