APR 4 1984 BOOK 56 ` PAGE 653 ` <br />those principles set forth in the case captioned; Contractors and <br />Builders Association of Pinellas County v City of Dunedin, 329 <br />So.2d 314 (1976) as further interpreted from time to time by the <br />Supreme Court of the State of Florida and various appellate <br />courts. <br />G. Use of funds previously collected. The use of any <br />funds previously collected by the County under Ordinance No. 80-22 <br />or 80-21 as plant capacity fees or contributions in aid of <br />construction are hereby restricted for use for the purpose for <br />which they were collected. In no event shall any of such funds <br />ever be used in a manner contrary to the principles set forth in <br />the case of Contractors and Builders Association of Pinellas <br />County v. City of Dunedin, 329 So.2d 314 (1976) as interpreted by <br />the Supreme Court of the State of Florida and appellate courts <br />from time to time. Under no circumstances shall any funds <br />collected under the terms of any previously adopted ordinance or <br />under the terms of this ordinance be expended for any purpose <br />other than extending, oversizing, separating, or constructing new <br />additions to the treatment plant or collection and interceptor <br />systems of the water and wastewater system so as to meet the <br />increased demand which additional connections to the system <br />create. <br />H. Time payment of impact fee upon showing of hardship. <br />The Board of County Commissioners may establish an alternate <br />method of payment for units presently in existence which have <br />received occupancy permits from the County. <br />Upon a showing of proper hardship to the <br />Commission, the Commission may allow in its sole discretion pay- <br />ment of the water and/or sewer impact fees in whole or in part <br />over a period of three (3) years at such interest rate to be <br />determined by the Board. <br />Upon the Commission's authorizing an alternate pay- <br />ment schedule for an applicant, a. lien for the amount due shall be <br />executed in recordable form reflecting the payment schedule and <br />filed in the public records of Indian River County, Florida. Upon <br />all payments being made in full, said lien shall be released of <br />
