APR 4 1994 <br />BOOK' S& PACE667'. <br />r <br />behalf thereof who shall violate or fail.to comply with any of the <br />provisions of this article shall, upon conviction, be punished by <br />a fine not to exceed five hundred dollars ($500.00). The Board of <br />County Commissioners may enforce the provisions of this article by <br />seeking injunctive relief or any other remedies provided by law. <br />SECTION 39 <br />REPEAL OF CONFLICTING PROVISIONS <br />All previous ordinances, resolutions, or motions of the <br />Board of County Commissioners of Indian River County, Florida <br />which conflict with the provisions of this ordinance are hereby <br />repealed to the extent of such conflict. All Special Acts of the <br />legislature applying only to the unincorporated portion of Indian <br />River County and which conflict with the provisions of this ordi- <br />nance are hereby repealed to the extent of such conflict. Specif- <br />ically, Section 24-31 through and including Section 24-67 of the <br />Code of Laws and Ordinances of Indian River County including <br />ordinances numbered 80-13, 80-21, 80-22, and 82-22 are hereby <br />repealed in their entirety and Section 1 through 38 of this ordi- <br />nance shall be inserted in their place according to.Section 40 <br />hereof. <br />SECTION 40 <br />INCORPORATION IN CODE <br />The provisions of this ordinance shall be incorporated <br />into the County Code and the word "ordinance" may be changed to <br />"section", "article", or other appropriate word, and the sections <br />of this ordinance may be renumbered or relettered to accomplish <br />such .intentions. <br />SECTION 41 <br />SEVERABILITY <br />If any section, part of a sentence, paragraph, phrase or <br />word of this ordinance is for any reason held to be unconstitu- <br />tional, inoperative or void, such holdings shall not affect the <br />remaining portions hereof and it shall be construed to have been <br />the legislative intent to pass this ordinance without such uncon- <br />stitutional, invalid or inoperative part. <br />=28- <br />
