Hamilton REFERENCES: A) Special Acts <br />Franchise Administr for Chapter 59-1380 <br />Utility Services <br />DESCRIPTION AND CONDITIONS: <br />As you are aware, our current method of lagooning septage <br />at our Landfill is going to be phased out by DER in the <br />near future. On October 12, 1983, Environmental Health <br />Director, --M. J. Galanis came before you with a presentation <br />from the H.E.S. corporation, a company which treats septage <br />and makes it into a bi-product which is environmentally <br />safe to dispose. <br />The Board instructed this department's staff to work with <br />HES and come back with a franchise proposal and also to <br />address the franchise requirement for the existing tank <br />truck operators. <br />Since that date, this department has been contacted by two <br />other companies interested in performing similar services. <br />ALTERNATIVES AND ANALYSES: <br />Competition might well serve the need to keep this type of <br />operation competitive in rates and other agencies (i.e. DER) <br />will serve as the regulatory agents to insure compliance <br />with state health laws. <br />Therefore, this department is looking solely to the tank <br />truck operators in the same manner as we look to haulers <br />of solid waste. <br />Franchising the haulers will serve two purposes: <br />1) regulate rates charged to consumers <br />2) deter dumping loads in isolated locations by <br />making this action grounds for default of franchise <br />thereby putting hauler out of business <br />RECOMMENDATION: <br />Special Acts Chapter 59-1380, Section 2(c)(2) authorizes the <br />Board to grant franchises for any undertaking in which sewage <br />is received, processed, treated and/or distributed (Exhibit "A"). <br />The Board has had this authority to regulate this utility <br />since May 9, 1959. At this time, staff recommends the Board <br />activate its authority to franchise septage haulers. <br />10 <br />
