DESCRIPTION AND CONDITIONS: <br />Florence Acres is a 13 lot, 9 acre subdivision. The subdivi- <br />sion is located on the north side of 4th Street west of 38th <br />Avenue. The subject property is zoned R-1 (6.2 dwelling <br />units/acre) and has a LD -2 land use designation (6 dwelling <br />units/acre). The subdivision's proposed density is 1.4 dwell- <br />ing units/acre. <br />Florence Acres received preliminary plat approval from the <br />Board of County Commissioners on May 5, 1982. According to <br />Section A(3)(g) of the County's Subdivision Ordinance 75-3. <br />"(g) The following limitations and conditions are placed <br />on the preliminary plat approvals given by the Board: <br />(1) The approval of the Board shall have full force <br />and effect for a period of -18 months from the <br />date of approval. An extension may be granted <br />by the Board. <br />(2) If no final plat has been filed for the area <br />covered by the preliminary plat before the <br />approval period has elapsed, the approval shall <br />be revoked. If final plats are filed for only a <br />portion of the preliminary plat, the approval on <br />the remaining portions shall be revoked unless, <br />an extension of time has been granted by the <br />Board." <br />Thus, according to. the subdivision ordinance which was in <br />effect at the time that this plat was approved, the preliminary <br />plat of Florence Acres expired on November 5, 1983. <br />The applicant is requesting that the Board of County Commis- <br />sioners grant a variance from this provision of the subdivision <br />ordinance, thus, in effect, granting an after -the -fact exten- <br />sion of preliminary plat approval. <br />ALTERNATIVES AND ANALYSIS: <br />In evaluating this request, staff took two factors into consid- <br />eration. First, staff considered what new County Ordinances <br />have been adopted since the preliminary plat of Florence Acnes <br />was approved, enforcement of which would benefit the County. <br />SecW103.v- Staff considered the progress which the applicant has <br />mare iTi %oinp] eti ng the subdivision's improvements. Si nr7p +-hn <br />subject plat was approved, the County has adopted its Compre- <br />hensive Plan, as well as new subdivision, stormwater <br />management and flood protection and tree protection ordinances. <br />The plat conforms to the standards in the County's newly <br />adopted land development regulations, with one exception. The. <br />County's Thoroughfare Plan categorizes 4th Street as a primary <br />collector street. The required right-of-way width for a <br />primary collector street is 100'. The plat of Florence Acres <br />shows an existing 60' right-of-way, with an additional 10' <br />being dedicated at the time of final plat approval. Thus, <br />there is 70' of right-of-way, where 100' is needed. Staff <br />recommends that the applicant reserve An additional 30' of <br />right-of-way along the length of the development's 4th Street <br />frontage. This can be done without changing the size or <br />configuration of the lots in the subdivision. The only lot <br />which would be affected is Lot 1. The approved preliminary <br />plat shows a 50 foot building setback line along this lot's 4th <br />Street frontage. A 20 foot front yard setback is required in <br />-the R-1 zone. Thus, the applicant can change the 50 foot <br />building setback line to a 30 foot road right-of-way reserva- <br />tion and still have a 20 foot building setback as required by <br />the ordinance. <br />AFR <br />181984__ <br />- p <br />13 c� <br />ROOK J6 PAGE 14J <br />
