MAY 21994 BOOK 56 PACE 898 <br />Chairman Scurlock questioned how anyone can comment <br />intelligently on a proposal that is going to be amended and <br />come back to the Board in a different form. <br />Mr. Pollard stated that he had no objections to the <br />procedure staff is proposing; the numbers they will present <br />today will not change and the homeowners just want them <br />taken and put into the record and reviewed by staff before a <br />recommendation is made. <br />Chairman Scurlock asked if the homeowners would not <br />have an objection to an order taken in their absence as he <br />felt there would be a recommendation as to rates within a 90 <br />day period. <br />Mr. Pollard stated that they would not as long as their <br />numbers are entered and taken into consideration. He <br />continued that he would however, object to the transfer of <br />the franchise at this time because there are numbers which <br />are going to come up today where there is a dual responsi- <br />bility between the seller and buyer of the assets, and until <br />these numbers are put in the right place and it can be <br />determined who is responsible, he did not feel the assets <br />should be transferred. He stated that he is primarily <br />referring to CIAO. <br />Attorney Brandenburg asked if Attorney Henderson would <br />be willing to stipulate for all Mr. Pollard's material to be <br />received into the record right now so it does not need to be <br />read out and gone over individually. <br />Attorney Henderson believed he would if he could ask <br />Mr. Pollard some questions. <br />Chairman Scurlock swore in Eric Pollard. <br />Attorney Henderson asked Mr. Pollard if the numbers he <br />is referring to relate to CIRC. <br />Mr. Pollard stated that they relate to CIAO, to capital <br />equipment, insurance, taxes, expenses, etc., and he did not <br />feel he could hand all this in without reviewing it first. <br />99 <br />
