MAY 2 1984 BOOK 56 PAGE 860 <br />Attorney Brandenburg stated that all the materials that <br />have been submitted, including the briefs by both sides, <br />have been reviewed in this process and this order is a final <br />order on all those items, and puts to an end all the pending <br />items that the County has with respect to Hutchinson <br />Utilities, Inc. at this point in time. <br />Commissioner Bird asked Attorney Brandenburg to briefly <br />summarize the order again regarding the effect on past rates <br />and possible future rates. <br />Attorney Brandenburg explained that: <br />1) The order determines that the past rate of the utility <br />to the customers has been fair and reasonable. In fact, it <br />may have been low, causing the utility to lose money which <br />they cannot now recoup in future rates. <br />2) The order determines there is no positive action taken <br />in this order with respect to the recision of the contract <br />issue; meaning that the County continues to believe that the <br />franchise issued to Hutchinson Utilities is a proper, <br />correct franchise which was transferred properly. <br />3) The order determines that, taking into account all other <br />financial information, including their request to build a <br />future plant if necessary, they should be entitled to adjust <br />their tariff and to increase it by an adequate amount. <br />Commissioner Wodtke asked how the actual rate will be <br />determined. Attorney Brandenburg explained that <br />Hutchinson Utilities will submit a tariff and in that tariff <br />they will lay out how they want to distribute the increase <br />amongst the various charges that they impose on their <br />customers to raise the specific amount of money. <br />Commissioner Wodtke asked if that will be the next <br />public hearing and Attorney Brandenburg stated that we will <br />have to take a look at whether or not that will have to be a <br />public hearing. It will be reviewed by the Utilities <br />Department and it may come to the Board in the form of a <br />64 <br />
