JOHNS RIVER DISTRICT <br />Complainant, <br />VS. <br />INDIAN RIVER COUNTY, <br />a Political Subdivision of the <br />State of Florida, <br />Respondent. <br />CERTIFIED MAIL: 7236045 <br />OGC Case No. 82-0267 <br />AMENDED CONSENT ORDER <br />This Consent Order is made and entered into between the State of <br />Florida Department of Environmental Regulation ("Department") and <br />Indian River County, Florida, ("Respondent"), and amends certain time <br />schedules established in Consent Order OGC'82-0267, which took effect <br />on July 27, 1982. <br />The Department finds and Respondent admits the following: <br />1. Respondent purchased from Treasure Coast Utilities, Inc. a <br />Florida Corporation, a sewage treatment plant and a community public <br />water system located at or near an area known as Whispering Palms, <br />also known as Dixie Gardens Subdivision, Indian River County, Florida. <br />Also, Respondent purchased from Ixora Utilities similar systems, <br />located at 180 Emerson Avenue, Vero Beach, Florida (Latitude: <br />26°36'05" and Longitude: 80°24148"). <br />2. These systems were the subject of litigation with the State <br />of Florida, Department of Environmental Regulation, and were concluded <br />to be in violation of Chapter 403, Florida Statutes, and the rules <br />promulgated thereunder, with regards to the adequate treatment of <br />water and the treatment and disposal of domestic wastewater. <br />MAY 2 3 1984 BOOK '57 PAGE 2,630 <br />J <br />
