Entry of this Consent Order does not relieve Respondent of <br />the need to comply with applicable federal, state, or local laws, <br />regulations, or ordinances. The entry of this Consent Order does not <br />abrogate the rights of substantially affected persons who are not <br />parties to this Order, pursuant to Chapter 120, Florida Statutes. <br />13. The terms and conditions set forth in the Consent Order may <br />be enforced in a court of competent jurisdiction pursuant to Sections <br />120.69 and 403.121, Florida Statutes. Failure to comply with terms of <br />this Consent Order shall consitute a violation of Section <br />403.161(1)(b), Florida Statutes. <br />14. Respondent is fully aware a violation of the terms of this <br />Consent Order may subject Respondent to judicial imposition of <br />damages, civil penalties of up to $10,000 per offense, and criminal <br />penalties. <br />15. This Consent Order shall take effect upon the date of filing <br />and acknowledgement by the Clerk of the Department and shall <br />constitute final agency action by the Department pursuant to Section <br />120.69, Florida Statutes and Florida Administrative Code Rule <br />17-1.58(3). <br />16. Respondent shall publish, at its expense within 10 days of <br />the effective date of this Consent Order, in the legal ad section.of a <br />newspaper of general circulation in Indian River County, and shall <br />provide proof of publication to the Department within seven days of <br />publication, the following notice: <br />"Notice of Agency Action" <br />The Department of Environmental Regulation gives <br />notice of Agency Action of entering into a Consent Order <br />with Indian River County pursuant to Florida Administrative <br />Code Rule 17-1.58. The Consent Order address activities <br />directed toward the removal of the Dixie Gardens and Ixora <br />Utilities sewage treatment plants from service within a <br />specific time schedule. <br />The Consent Order is available for public inspection <br />during normal business hours, 8:00 a.m. to 5:00 p.m., <br />Monday through Friday, except legal holidays, at the <br />Department of Environmental Regulation, 3319 Maguire <br />Boulevard, Suite 232, Orlando, Florida 32803. <br />-5- <br />MAY 2 3 1984, BOOK 57 PAGE 234 <br />
