Craver REFERENCESNBA ROW Aband. <br />Staff Planner KAREN <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of May 23, 1984. <br />DESCRIPTION & CONDITIONS <br />In March of this year, North Beach Associates submitted a <br />right-of-way abandonment petition to the Planning and <br />Development Division. The petition requests that the County <br />abandon a 35 foot wide County recorded road dedication, <br />together with whatever rights the public may have in and to the <br />actual soil road located partially within and without the <br />right-of-way. The soil road is not maintained by the County. <br />The right-of-way transverses a 26.35 acre parcel, owned <br />entirely by North Beach Associates, on the west side of State <br />Road A -1-A, one-half mile north of County Road 510. <br />In accordance with the administrative guidelines approved by <br />the Board of County Commissioners for the processing of <br />right-of-way abandonment applications, the request was reviewed <br />by all County Divisions and utility providers having <br />jurisdiction within the right-of-way. Both Southern Bell and <br />Florida Power and Light stated that the request would be <br />approved if a 10 foot wide easement was retained to provide for <br />the servicing of an existing customer on Jungle Trail.. The <br />County Traffic Engineer and the County Surveyor disapproved of <br />the abandonment, while the County Utilities Division approved <br />of it. <br />ANALYSIS <br />On April 12, 1984, the Planning and Zoning Commission <br />unanimously voted to recommend to the County Commission that <br />the 26.35 acre tract be rezoned from R -J. to R -2D. The R -2D <br />zoning allows up to 6 units/acre as does the existing LD -2 land <br />use designation. The rezoning request was on the May 16th <br />County Commission agenda. It is the intent of North Beach <br />Associates to develop a multi -family condominium complex on the <br />tract and the existing right-of-way is viewed as a hindrance <br />to the project. <br />41 <br />MAY 2 3 1984 BOOK ,57 FAGG 160 <br />
