Chairman Scurlock continued the Public Hearing and <br />asked if anyone wished to be heard in this matter. There <br />were none. <br />ON MOTION by Commissioner Bird, <br />SECONDED by Commissioner Wodtke, the <br />Board unanimously closed the Public Hearing. <br />MOTION WAS MADE by Commissioner Lyons, <br />SECONDED by Commissioner Wodtke, that the Board <br />approve the petition by North Beach Association <br />and adopt Resolution 84-34 providing for the <br />abandonment of a 35 -foot wide County recorded road <br />dedication; retaining the right-of-ways of the two <br />existing utilities, (Southern Bell and Florida <br />Power & Light); contingent upon working out a <br />suitable agreement with the applicant providing <br />for the pavement of the road and the posting of a <br />performance bond. <br />Under discussion, Attorney Brandenburg assured <br />Commissioner Wodtke that the County is retaining the right <br />of the existing utilities to remain there if that is their <br />desire. It is anticipated that the developer will work out <br />an arrangement with the two existing utilities to relocate, <br />in which case that would extinguish the easement under the <br />terms of the abandonment and they could go about their <br />business of building over the top of it. <br />THE CHAIRMAN CALLED FOR THE QUESTION. <br />The Motion was voted on and carried <br />unanimously (4-0). <br />RESOLUTION 84-34 WILL BE MADE A PART OF THE RECORD WHEN <br />EXECUTED AND RECEIVED, <br />43 <br />` MAY 2 3 1984 <br />BOOK 57 FADE 152 <br />
