U <br />EXHIBIT "A" <br />1. Right -of -Way permit from Indian River County Farms Water <br />Control District. Application has been submitted and permit is <br />scheduled to be issued on June 15, 1984. <br />2. In the event a Right -of -Way gap is subsequently discovered, <br />the Board of County Commissioners has the authority to exercise <br />the right and power of Eminent Domain pursuant to Florida <br />Statutes Section 127.01(1) and 153.03(5). <br />LICENSE AGREEMENT WITH FLORIDA EAST COAST RAILROAD <br />Attorney Brandenburg informed the Board that we have <br />just received a License Agreement with the railroad which we <br />must have executed before we can start work on boring and <br />jacking under the railroad crossing at 12th Street. <br />ON MOTION by Commissioner Lyons, SECONDED <br />by Commissioner Bird, the Board unanimously <br />(4-0) authorized the Chairman to execute the <br />License Agreement with the Florida East Coast <br />Railway Company as described above. <br />Said Agreement will be made a part of the Official <br />Record when fully executed and received. <br />RECOMMENDATION RE BARRIER ISLAND NAME <br />The Board reviewed the following letter received from <br />the chairman of the Scenic Roads and Trails Committee: <br />76 <br />L- JUN A 11984 Boas 57 PAGE 371 <br />
