JU11 <br />L <br />work provided for in this Contract has been completed, <br />and acceptance by him under the terms and the conditions <br />thereof is recommended and the entire balance found <br />to be due the Contractor will be paid to the Contractor <br />by the County following County Commission's approval <br />of the final Contract payment. <br />Prior to final acceptance by the Engineer, the Con- <br />tractor shall verify, in the Engineer's presence, <br />that all facilities or equipment, etc. perform their <br />proper task or function in the manner in which they <br />were intended. The operation of all other equipment, <br />fittings, etc. which are necessary for the proper <br />functioning of the facility shall be tested, any <br />equipment, etc. that fails or is found to be improperly <br />placed or in any way does not perform as the design <br />intended shall be completely corrected by the Contrac- <br />tor at the Contractor's expense. Such equipment, <br />etc., shall then be retested by the Contractor in <br />the presence of the Engineer, until it is accepted <br />,by the Engineer. Issuance of final acceptance will <br />not be made until all equipment, etc., have been <br />approved by the Engineer. <br />Before issuance of final certificate,. the Contractor <br />shall submit evidence satisfactory to the County <br />Engineer that all payrolls, material bills, and other <br />indebtedness connected with the work have been paid. <br />An affidavit must be submitted by the Contractor <br />to the County Engineer stating that all indebtedness <br />connected with the work has been paid. Such affidavit <br />will be signed by a duly authorized officer of the <br />contracting firm, will bear the firm's seal, and <br />will be notarized and attested by two witnesses. <br />A Waiver -of -Lien form signed by a duly authorized <br />officer of the subcontracting firm, notarized and <br />attested by two witnesses is required from each Sub <br />contractor engaged under the scope of tYis Contract, <br />and must accompany the request for final payment. <br />The making and acceptance of the final payment shall <br />constitute a waiver of all claims by the County, <br />other than those arising from unsettled liens, from <br />faulty work appearing after final payment or from <br />requirements of the Specifications and of all claims <br />by the Contractor, except those previously made and <br />still unsettled. <br />Article 6. THE CONTRACT DOCUMENTS: Call for Bids, Addendum <br />as Required, Instructions to Bidders, General Condi- <br />tions, Sup"_ementary General Conditions, Certifications <br />or Nonsecr_:sted Facilities, Bid Proposal Question- <br />naire Bid Sond, Form of Agreement, Opinion of Attorney, <br />Affidavit, Final Payment, Periodic Estimate for Par- <br />tial Payme-=, Technical Specifications, and the <br />Drawings, _form the Contract and they are as full,, <br />a part o_f-is Contract as if the same were hereto <br />attached or herein repeated. <br />9 <br />6 1984 BOOK 57 PAcE26.9 <br />
