WHEREAS, the Land Company has objected to the <br />permitting of the project and the matter has been referred to an <br />administrative hearing officer under the provisions of Florida <br />Statutes 5120, <br />NOW THEREFORE, the parties desire to resolve their <br />differences by entering into this agreement, forever settling the <br />location and public ownership of Jungle Trail as it transverses <br />the Land Company's property and the boundary line of the Land <br />Company's property; the parties agree as follows: <br />1. The foregoing recitals are true and correct and <br />incorporated herein as a representation of the parties upon which <br />this agreement is based. <br />2. County hereby authorizes the County Attorney to <br />prepare and the Chairman of the County Commission and Clerk to <br />execute a County Deed in favor of the land company containing the <br />legal description as set forth in Exhibit "A" of that portion of <br />the roadway as described on the 1976 Maintenance Map, that exists <br />west of the new alignment of the road, and including the following <br />language: <br />"The purpose of this deed is to convey all the right <br />title and interest of Indian River County in and to the above <br />described property arising by virtue of the filing of that certain <br />Maintenance Map recorded in Official Record Book 9 , page 40 , <br />public records of Indian River County, Florida." <br />3. Indian River County shall take all actions neces- <br />sary to clear the public records of the 1976 Maintenance Map for <br />the length of the Land Company's property. Indian River County <br />may file a new Maintenance Map showing the road as realigned <br />according to the legal description set forth in attachment "B" <br />hereto. (o'5��� �,•�/ <br />4. �\Prio P£o the County's actions taken with respect <br />\ `.,, Y P <br />to paragraphs'2 and�3�kl_ve, the Land Company shall deed to Indian <br />River County by warranty deed all land comprising the new right- <br />of-way as set forth in Attachment "B" hereto, together with any <br />releases that may be necessary to clear the property of any <br />mortgages.
