Allocations are not <br />given on speculation. <br />Commissioner Wodtke asked if a court order were issued <br />that stated it is the City's responsibility to service the <br />south beach area, would this agreement be saying that they <br />will be able to transfer the 6th Ave. 600,000 gallons to <br />south beach. <br />Attorney Brandenburg assured Commissioner Wodtke that <br />the 600,000 gallon capacity is only for the south mainland. <br />In the event that the County was to sue the City and the <br />court said that the City would have to service all the south <br />mainland area with unlimited capacity which may exceed the <br />600,000, the City would give us notice that they are no <br />longer going to service the hospital node on a temporary <br />basis. This paragraph only relates to the south mainland. <br />Chairman Scurlock wanted the Commission to be aware <br />that he did contact the City of Vero Beach after the City <br />Council meeting at which the south beach issue was <br />discussed. He reported that Mayor Gregg will be out of town <br />until late June and, therefore, there is no one with which <br />to negotiate. He stressed that he is following up with a <br />formal letter indicating that he has made the effort. <br />Commissioner Wodtke was concerned that the wording in <br />Section 2 could be interpreted to mean that we could lose <br />100,000 gallons from the south mainland 600,000 gallons and <br />suggested the deletion of the clause "or be relinquished to <br />the City". The Commissioners agreed that this phrase should <br />be stricken from the agreement. <br />Attorney Brandenburg explained that this agreement was <br />reviewed by City Attorney Charles Vitunac and Tom Nason, and <br />he had received a call this morning indicating the agreement <br />was satisfactory to them with one change in Section 4.
