MOTION WAS MADE by Commissioner Lyons, SECONDED <br />by Commissioner Bird, authorizing the County <br />Attorney to deed the above lakes to the property <br />owners association, if one is formed, and if not, <br />to prepare a Resolution disclaiming the County's <br />interest in said lakes. <br />Question arose as to who would own this property in the <br />event Glendale Lakes Subdivision did not form a property <br />owners association, and Commissioner Lyons inquired about <br />the possibility of subdividing these properties and adding <br />them to the surrounding owners' lots. <br />Attorney Brandenburg could not recommend splitting up <br />the lakes and giving them to the abutting owners since the <br />other people in the subdivision also feel they have a right <br />to the lakes, and we could get into a real hornet's nest. <br />Discussion continued as to who would own the lakes, and <br />Chairman Scurlock felt possibly the developer. <br />Attorney Brandenburg did not feel we would want to go <br />on record as giving these back to the original subdivider <br />either as he believed the people in the subdivision felt <br />those lakes were there for their use and the developer was <br />giving up all rights; therefore, the Attorney still <br />recommended that the County try to give these properties <br />back to a property owners association and disclaim any <br />interest. <br />THE CHAIRMAN CALLED FOR THE QUESTION. <br />It was voted on and carried unanimously (4-0). <br />Attorney Brandenburg then informed the Board that there <br />are two other parks, both of which are small lots which were <br />dedicated to the County as parks.
