RESOLUTION NO. 2010- 043 <br />A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN <br />RIVER COUNTY, FLORIDA, AUTHORIZING THE CHAIRMAN TO REQUEST THE <br />FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT") TO CONVEY <br />SURPLUS PROPERTY TO INDIAN RIVER COUNTY ("COUNTY") TO BE <br />UTILIZED FOR THE PUBLIC PURPOSE OF PROVIDING DRAINAGE AND <br />IMPROVING 82ND STREET, SUCH PROPERTY BEING IDENTIFIED IN THE <br />LEGAL DESCRIPTION AND SKETCH ATTACHED TO THIS RESOLUTION <br />LABELED AS EXHIBIT "A"; PROVIDING AN EFFECTIVE DATE; AND FOR <br />OTHER PURPOSES. <br />WHEREAS, the FDOT acquires properties for transportation facilities for the citizens of the <br />State of Florida; and <br />WHEREAS, the FDOT is permitted by law to convey real property that FDOT no longer <br />needs and determines to be surplus to other public entities to further the public needs of the State of <br />Florida; and <br />WHEREAS, the County can utilize FDOT's surplus property described on the attached <br />Exhibit "A" for necessary drainage facilities and a potential expansion of 82nd Street; and <br />WHEREAS, it is in the best interest of the citizens of the State of Florida to gain the most <br />benefit from properties acquired with public funds; and <br />WHEREAS, the County is requesting that FDOT convey to the County the surplus property <br />described on the attached Exhibit "A"; and <br />WHEREAS, the surplus property is sought for the potential expansion of 82nd Street and is <br />proposed to be conveyed to the County for the public purpose of providing necessary drainage <br />facilities pursuant to that expansion. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, THAT <br />SECTION 1: The foregoing recitals are true, correct and incorporated into this Resolution by this <br />reference. <br />SECTION 2: The County requests the FDOT to convey title to the surplus property described on <br />the attached Exhibit "A" to the County pursuant to Section 337.25(4)(h), , Florida Statutes. <br />F:1Public Works\Luanne M\Resolutions182nd St FOOT specific purpose of property resolution 05-12-10.doc <br />
