Craver -i C REFERENCES: 40th Ave. <br />Staff Planner DIS:KAREN <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of July 18, 1984. <br />DESCRIPTION AND CONDITIONS: <br />On June 6, 1984, the Board of County Commissioners granted <br />conceptual approval of the abandonment of a portion of 40th <br />Avenue lying south of 14th Street. The abandonment petition <br />was submitted in conjunction with a request to construct a <br />cul-de-sac on 40th Avenue, south of 14th Street, within <br />Phyl-Ann Terrace Subdivision. The cul-de-sac was approved, and <br />through the development of construction drawings, a legal <br />description of the right-of-way to be abandoned was estab- <br />lished. At this time it is necessary that a formal public <br />hearing be held regarding the abandonment of 60 feet of 40th <br />Avenue right-of-way, lying immediately south of 14th Street. <br />ANALYSIS: <br />In accordance with the administrative guidelines approved by <br />the Board of County Commissioners for the processing of <br />right-of-way abandonment applications, the request was reviewed <br />by all County divisions and utility providers having jurisdic- <br />tion within the roadway. The abandonment was approved by all <br />parties contacted and easements will be retained for all <br />existing sewer and water lines. <br />RECOMMENDATION: <br />Staff recommends that the County Commission grant formal <br />approval of the petition to abandon that portion of 40th Avenue <br />beginning at the south right-of-way line of 14th Street and <br />extending 60 feet to the south. <br />The Chairman asked if anyone present wished to be <br />heard. <br />Attorney Brandenburg, speaking in behalf of residents <br />on the subject portion of 40th Avenue, stated that they <br />appreciate the Board's action in pursuing this matter and <br />they would appreciate a positive vote on the proposed <br />abandonment. <br />34 <br />C_ I <br />
