establishment. Mr. Smith believed that in Sebastian and <br />Fellsmere, it is only required that an establishment such as <br />he is proposing be 500' away from a church or school. He <br />noted that an article in the paper has stated that some of <br />the residents of the community feel there are too many bars <br />in Gifford, but he does not feel that is true as there are <br />only about 3 or 4 licensed establishments where liquor can <br />be consumed on the premises. As for the remainder of the <br />county, he pointed out that there are nice lounges all along <br />the river and the ocean, and he has not heard anyone speak <br />out against them. Mr. Smith emphasized that he did not come <br />here to create a controversy; he just wanted the Commission <br />to understand that without a license for consumption on <br />premises, he might as well close up shop. <br />Commissioner Wodtke wished to know how far Mr. Smith's <br />business is from the nearest church or school. <br />Planning Director Keating reported that this business <br />is 1350' from Middle 6 and Middle 7 Schools; 1150' from <br />Davis Temple Church, and 1200' from Friendship Baptist <br />Church. <br />Commissioner Bird stated that he felt what we need to <br />do is determine what is reasonable and be consistent <br />throughout the county. He did not believe we can develop a <br />different criteria for Gifford. <br />Commissioner Wodtke asked if the County can have one <br />stipulation and the municipalities another, or whether a <br />standard is set by the state. He assumed this requirement <br />is less in the City of Vero Beach. <br />Attorney Brandenburg did not know the City's require- <br />ment, but informed the Board that we currently have on our - <br />books a special provision dating back to 1967 that applies <br />only to that area along North Gifford Road west of its <br />intersection with Highway I, which says it doesn't matter if <br />there are churches or anything else, you can't have such an <br />41 <br />8000. <br />JUL 1,8 1984 - 57 Fr,�� 75 <br />
