RESOLUTION NO. 2011- 069 <br />A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA ESTABLISHING GUIDELINES <br />FOR QUASI-JUDICIAL PROCEEDINGS BEFORE THE BOARD. <br />WHEREAS, the Board of County Commissioners ("Board") conducts quasi-judicial <br />proceedings from time to time with regard to matters of interest to residents of Indian River <br />County; and <br />WHEREAS, the interests of all residents, including parties to quasi-judicial proceedings, <br />will be served if the Board adopts and publishes written guidelines applicable to quasi-judicial <br />proceedings, as set forth herein. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY that: <br />1. Guidelines. The Board hereby adopts the attached "Indian River County <br />Guidelines for Quasi -Judicial Proceedings before the Board of County Commissioners" <br />("Guidelines"). The Guidelines are for information purposes only, and shall not impose upon the <br />Board any legal requirements greater than those imposed by applicable law. The Board, acting <br />in accordance with section 102.02 of the Code of Indian River County, is authorized to deviate <br />from the Guidelines, provided the resulting procedure complies with applicable law. No <br />deviation from the Guidelines shall be considered a failure of the Board to follow its own rules, <br />policies or procedures. <br />2. Planning and Zoning Commission. The Planning and Zoning Commission is <br />invited to consider and adopt the Guidelines for application to quasi-judicial proceedings <br />conducted by the commission. <br />3. Contrary Resolutions. Any contrary resolutions, including, without limitation, <br />Resolution 2009-004, are hereby repealed. <br />The foregoing resolution was moved for adoption by Commissioner 01 Bryan <br />and the motion was seconded by Commissioner Davis , and, upon being put to a <br />vote, the vote was as follows: <br />1 <br />
