RESOLUTION NO. 2010- 028 <br />A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA, CALLING A REFERENDUM <br />WITHIN ITS TOTAL JURISDICTION TO DETERMINE WHETHER <br />THE BOARD OF COUNTY COMMISSIONERS SHOULD BE <br />AUTHORIZED TO GRANT ECONOMIC DEVELOPMENT AD <br />VALOREM TAX EXEMPTIONS TO NEW BUSINESSES AND <br />EXPANDING BUSINESSES. <br />WHEREAS, §3, Article VII of the Florida Constitution provides that a county may grant <br />community and economic development ad valorem tax exemptions to new businesses and <br />expansions of existing businesses, only after the electors of the county approve such authority in <br />a referendum; and <br />WHEREAS, §196.1995, Florida Statutes provides that the Board of County <br />Commissioners may vote to hold such a referendum within its total jurisdiction; and <br />WHEREAS, the Board of County Commissioners of Indian River County desires to hold <br />such a referendum in conjunction with the general election presently scheduled to be held on <br />November 2, 2010; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, THAT <br />1. Referendum. A referendum shall be held within the total jurisdiction of Indian <br />River County, Florida, to determine whether the Board of County Commissioners of Indian <br />River County shall be authorized to grant economic development ad valorem tax exemptions <br />under §3, Article VII of the Florida Constitution and §196.1995, Florida Statutes. <br />2. Ballot Question. The ballot question in such referendum shall be in the <br />following form: <br />"ECONOMIC DEVELOPMENT AD VALOREM TAX EXEMPTIONS <br />Shall the board of county commissioners of this county, be authorized to grant, <br />pursuant to s. 3, Article VII of the State Constitution, property tax exemptions to <br />new businesses and expansions of existing businesses? <br />Yes - For authority to grant exemptions. <br />No - Against authority to grant exemptions." <br />3. General Election. The referendum shall be held in conjunction with the general <br />election, presently scheduled to be held on November 2, 2010. <br />4. Notice of Referendum. Staff is directed to provide notice of such referendum as <br />set forth in § 100.342, Florida Statutes. <br />1 <br />
