The Board reviewed the following memo dated 7/23/84: <br />July 23, 1984 <br />TO: Sheriff Dobeck <br />FROM: John Jones <br />REF: Automobiles sold at Sheriff's sales, May 16, 1984 <br />a. - (2) 1981 Harley Davidson Police Motorcycles <br />b. - (5) 1980 Mercury Marquis <br />c. (1) 1979 Cougar <br />d. - (1) 1978 Plymouth Volare <br />e. - (1) 1978 Ford Station Wagon <br />f. - (1) 1981 Mercedes <br />Item (e. and f.) were seized vehicles, awarded, titled, <br />and used by the Sheriff's Department prior to the May <br />16, 1984 sale. <br />Sheriff Dobeck pointed out that items "e" and "f" were <br />seized by the Sheriff's Dept. and were included in the last <br />report submitted to the Commission. He informed the Board <br />that a 1983 opinion by the Attorney General states that <br />after a law enforcement agency has elected to retain <br />forfeited property for the agency's use, the future sale of <br />that property is not subject to the provisions of the <br />Contraband Forfeiture Act, which means that this money can <br />be placed back into the Sheriff's budget for capital <br />expenditures, rather than being placed into the Commission's <br />forfeiture fund. He, therefore, requested that the <br />Commission give his department the $17,2575 derived from the <br />sale of these two vehicles in order to allow them to <br />purchase the vehicles they are requesting. <br />Attorney Brandenburg explained that the Sheriff has <br />taken a piece of confiscated property and designated it for <br />departmental use.
