AUG 1 1994 <br />Boc,5 57 NAGE 816 <br />Chief Planner Shearer displayed an aerial photo showing <br />the acreage previously rezoned to R-1 in this same area, and <br />informed the Board that the property in question is 330' <br />deep and 1h miles long. He noted that since the Land Use <br />Plan designation is LD -2, commercial zoning is not <br />appropriate. Mr. Shearer emphasized that staff feels all <br />the property should be rezoned, including the two lots the <br />Planning & Zoning Commission wishes left out. <br />Attorney Brandenburg pointed out that the rezoning of <br />those two lots was denied at the Planning & Zoning Commis- <br />sion and that denial is final unless the matter is appealed <br />to the County; therefore, we could not overturn that denial <br />today. The remainder can be rezoned, however. <br />The Chairman asked if anyone present wished to be <br />heard. There were none. <br />ON MOTION by Commissioner Lyons, SECONDED <br />by Commissioner Bird, the Board unanimously <br />closed the public hearing. <br />ON MOTION by Commissioner Wodtke, SECONDED <br />by Commissioner Lyons, the Board unanimously <br />adopted Ordinance 84-45 rezoning approximately <br />45.5 acres east of 27th Avenue and south of <br />Kelly Road from C-1 to R-1, with the exception <br />of the two lots at -the north end of the subject <br />property. <br />12 <br />
