The revenues so received shall be deemed to be Revenues derived from the operation of the <br />Facilities, and shall be deposited and accounted for in the same manner as other Revenues derived from such <br />operation of the Facilities. <br />L. ENFORCEMENT OF COLLECTIONS. The Issuer will diligently enforce and collect the rates, fees and <br />other charges for the services of the Facilities, will take all steps, actions and proceedings for the enforcement and <br />collection of such rates, charges and fees as shall become delinquent to the full extent permitted or authorized by <br />law; and will maintain accurate records with respect thereof. All such fees, rates, charges and revenues shall, as <br />collected, be held in trust to be applied as herein provided and not otherwise. <br />M. REMEDIES. Any holder of Obligations or any coupons appertaining thereto issued under the provisions <br />hereof or any trustee acting for the holders of such Obligations may by suit, action, mandamus or other <br />proceedings in any court of competent jurisdiction, protect and enforce any and all rights, including the right to <br />the appointment of a receiver, existing under the laws of the State of Florida, and may enforce and compel the <br />performance of all duties herein required or by any applicable statutes to be performed by the Issuer or by any <br />officer thereof. <br />Nothing herein, however, shall be construed to grant to any holder of such Obligations any lien on any <br />property of, or in, the Issuer. <br />N. OPERATING BUDGET. (1) The Issuer shall annually at least thirty (30) days preceding each of its <br />Fiscal fears, in cooperation with its Consulting Engineers, prepare and adopt a detailed final 'budget for the <br />operation of the Facilities during such next succeeding Fiscal Year. If the budget discloses that the estimated <br />Gross Revenues will be insufficient during such Fiscal Year to make fully the current payments required in this <br />resolution, then the Issuer shall forthwith revise the rates, fees, rentals or other charges in order to cure such <br />estimated deficiencies and to comply with the rate covenant as provided in Subsection 15F herein. (2} The <br />Consulting Engineers will annually review the depreciation schedules established for each major capital asset, the <br />same being any asset of the Facilities having an original acquisition cost in excess of $10,000. There shall be <br />included in the budget amounts necessary for deposit in the Renewal and Replacement Fund as stipulated but no <br />less than the amount necessary to provide for the orderly replacement of such depreciable capital assets in <br />accordance with the depreciation schedules that the Consulting Engineers shall establish. (3) No expenditure for <br />the Operation and Maintenance of the Facilities shall be made in any Fiscal Year in excess of the amounts <br />provided therefor in such budget without a written finding and recommendation by the general manager of such <br />Facilities or other duly authorized officer in charge thereof, which finding and recommendation shall state in <br />detail the purpose of and necessity for such increased expenditures for the Operation and Maintenance of the <br />Facilities and no such increased expenditures shall be made until the governing body of the Issuer shall have <br />approved such finding and recommendation by a resolution duly adopted. No such increased expenditures in <br />excess of ten per centum (10%) of the amount provided therefor in such budget shall in any event be made <br />except upon the further certificate of the Consulting Engineers that such increased expenditures are necessary <br />and essential to the continuance in operation of the Facilities. <br />O. CONSULTING ENGINEERS. The Issuer will annually retain an independent Consulting Engineer or <br />engineering firm having a favorable reputation for skill and experience for the design, construction and operation <br />of Facilities of comparable size and character as the Facilities, for the purpose of -providing the Issuer competent <br />engineering counsel affecting the economical and efficient operation of the Facilities and in connection with the <br />making of capital improvements and renewals and replacements of the Facilities. The Issuer may, however, <br />employ additional engineers at any time with relation to specific engineering and operation problems arising in <br />connection with the Facilities. <br />The Issuer shall, at least every two (2) years, cause to be prepared by the Consulting Engineers a report or <br />survey with respect to the management of the properties thereof, the sufficiency of the rates, and charges for <br />services, the proper maintenance of the properties of the Facilities and the necessity for capital improvements and <br />recommendations therefor. Such a report or survey shall also show any failure of the Issuer to perform or comply <br />with the covenants herein contained. <br />If any such report or survey of the Consulting Engineers shall set forth that the provisions hereof or any <br />reasonable recommendations of such Consulting I.ngincers have not been complied with, the Issuer small <br />19 <br />AUG 1 1984 BOOK 7 F,, 893 <br />-IV <br />
