Craver <br />REFERENCES: <br />ROW Aban <br />Staff Planner �`, <br />DIS:KAREN <br />It is requested that the data herein presented.be given formal <br />consideration by the Board of County -Commissioners at their <br />regular meeting of August 1, 1984. <br />DESCRIPTION AND CONDITIONS: <br />Throughout the past year, the County Attorney's Office and the <br />Public Works Division have been working with the property <br />owners along a portion of 2nd Street. The owners requested <br />that the County initiate the abandonment of that portion of 2nd <br />Street which curves northwesterly from the intersection of 2nd <br />Street and 16th Avenue to 17th Avenue (see attachment #2). The <br />petitioners cited -excessive traffic and speed as the _reasons <br />for the request. On April 6,•1983, the County Commission <br />approved a similar request to abandon the curved portion of 3rd <br />Street, between 18th and 19th Avenues. <br />In accordance with the administrative guidelines approved by <br />the Board of County Commissioners -for the processing of <br />right-of-way abandonment applications, the request -was reviewed <br />by all County Divisions and utility providers having jurisdic- <br />tion within the right-of-way. All County divisions approved <br />the abandonment and Southern Be'll' and Florida Power and Light <br />requested that easements be retained for their existing <br />facilities. The attached resolution provides for the retention <br />of said easements. The Planning staff concurs with the peti- <br />tioners' belief that the roadway 'creates a hazardous traffic <br />situation and, in light of the aforementioned abandonment of <br />3rd Street, feels that the request should be approved. <br />Due to the curved nature of the street, a small triangular- <br />shaped parcel, located at the northeast corner of 2nd Street <br />and 17th Avenue, was created at the time of platting. The <br />County has received.a Quit -Claim Deed from the developer to <br />ensure that no question arises regarding ownership once the <br />County discontinues its current policy of maintaining the <br />parcel as a park. The 4 property owners and the County have <br />agreed upon the final configuration of the lots following the <br />abandonment of the right-of-way. The, County -owned parcel, <br />together with a portion of the abandoned .right-of-way, will <br />constitute a totally new lot. The 4 lots now abutting the <br />right-of-way shall increase in varying degrees. The property <br />owners and the County have all executed Quit -Claim Deeds to <br />each other to eliminate any questions of who owns what after <br />the abandonment. The deeds, currently being held in escrow, <br />will be released following approval of the abandonment. <br />RECOMMENDATION: <br />Staff recommends approval of the petition to abandon that <br />portion of 2nd Street which curves northwesterly from the <br />intersection of 2nd Street and 16th Avenue to 17th Avenue. <br />35 <br />1 BOOK. �7 <br />AUG 1984 <br />
