In order to get them off the hook so that <br />they can commit to these tracts, we are getting the property <br />owners to agree that if the maximum price is less than the <br />option price, there are three alternative ways we can <br />proceed: <br />1) The County can elect to pick up the difference <br />between those two prices, or <br />2) Renegotiate a lower price with the property <br />owner, or <br />3) Drop the options, period. <br />ON MOTION by Commissioner Lyons, <br />SECONDED by Commissioner Wodtke, the Board <br />unanimously (4-0, Commissioner Bird having <br />left the meeting), approved the County Attorney's <br />recommendations. <br />NOTICES OF EXERCISING OPTIONS ARE ON FILE IN THE OFFICE OF <br />THE CLERK <br />REQUEST TO BRING SUIT AGAINST OWNERS OF VILLAGE GREEN <br />Attorney Brandenburg explained that the owners of <br />Village Green have been putting insufficient funds into <br />utility escrow accounts and they have fallen severely behind <br />in making those payments. He advised that Utilities <br />Director Pinto has been working with them over the last six <br />months to get those accounts updated, but they are gaining <br />at a very slow rate and are still $91,000 in arrears. <br />ON MOTION by Commissioner Lyons, <br />SECONDED by Commissioner Bowman, the Board <br />unanimously (4-0, Commissioner Bird having left <br />the meeting), authorized the County Attorney to <br />take the appropriate steps in connection with <br />Village Green. <br />61 <br />
