EXHIBIT C TO SETTLEMENT AGREEMENT <br />IN THE CIRCUIT COURT OF THE 19TH <br />JUDICIAL CIRCUIT, IN AND FOR <br />INDIAN RIVER COUNTY, FLORIDA <br />CASE NO. 20070109 CA19 <br />DIVOSTA HOMES, L.P., a foreign <br />limited partnership, and its general <br />partner, DIVOSTA HOMES HOLDINGS, <br />L.L.C, a foreign limited liability <br />company, <br />Plaintiffs, <br />v. <br />INDIAN RIVER COUNTY, a political <br />subdivision of the state of Florida, <br />Defendant. <br />STIPULATION FOR APPROVAL OF SETTLEMENT AGREEMENT <br />AND DISMISSAL WITH PREJUDICE <br />Plaintiffs, DiVosta Homes, L.P. and DiVosta Homes Holdings, L.L.C. (collectively <br />"DiVosta"), and Defendant, Indian River County ("County"), by and through their undersigned <br />counsel, stipulate and agree to the following: <br />1. That the parties have entered into a Settlement Agreement, a copy of which is <br />attached hereto as Exhibit 1. <br />2. That the Court is requested to enter its Final Order approving the Settlement <br />Agreement and incorporating the terms of the Settlement Agreement into the Final Order. <br />3.
