M M <br />Attorney Collins emphasized that, first of all, <br />realtors need to be able to represent to buyers and sellers <br />of property how that property can be used. The Compre- <br />hensive Plan did make it clearer for the realtors to say <br />whether property is or is not in conformance, but the nodal <br />areas remain a gray area, and from a liability standpoint, <br />the realtors have found it frustrating and difficult to deal <br />with the issue with any degree of reliance. He felt if the <br />Commission accepts the Planning Department's recommendation, <br />they are increasingly going to be put in the position of <br />making judgment calls of one property against another, <br />especially as the node begins to fill up. <br />Attorney Collins explained that basically the realtors <br />are saying let's accept the Plan as adopted, take the nodes <br />as they exist, and go ahead and rezone to the uses as <br />established by the Plan. He pointed out that, rightly or <br />wrongly, many transactions have taken place since the <br />adoption of the Comprehensive Plan where people have made <br />business decisions feeling that they were or were not in the <br />nodes, and by rezoning the properties now in the nodes, the <br />Board will dlarify that position for everybody. Attorney <br />Collins continued that the Board of Realtors feels planning <br />and zoning should not be based on a first come, first served <br />issue, but that it should be based on an overall view of the <br />situation, after which the Board should adopt policies and <br />then let growth occur according to those policies rather <br />than being in the position of reacting to events as they <br />arise. <br />Attorney Collins next addressed the issue of the <br />in -fill question and visualized that in a situation where <br />the inner core of 25% is filled up and projects have been <br />approved near the outer boundary, there would be tremendous <br />pressure on the Board to rezone all the land in between by <br />transferring allocations from somebody else. <br />23 <br />AUG 15 1984 <br />If the Board <br />BOOK 58 Fp;F �3 <br />
