RECOMMENDATION: <br />The staff' recommends that the Board .deny the appeal of the <br />Vista Royale .association and affirm the decision of the Plan- <br />ning and Zoning Commission in approving the subject site plan. <br />Planning & Development Director Robert Keating <br />explained that this is an appeal of a site plan approval by <br />the Planning & Zoning Commission of a retail center and <br />restaurant and presented an aerial view and location map of <br />the area. He advised that they also have a copy of the <br />original site plan available. At present, station WAXE has <br />a radio tower on the site. Prior to submitting the site <br />plan, the applicant, John Lyon, met with staff and after•the <br />plan was carefully reviewed, several suggestions were <br />incorporated into the site plan. Staff then made a positive <br />recommendation and took it to the Planning & Zoning <br />Commission which approved the site plan as submitted. On <br />August 20, 1984, J. E. Luckett, President of Vista Royale <br />Association, formally appealed the Planning and Zoning <br />Commission's approval of the Royale Garden Village site plan <br />application giving three major points of contention: <br />1) Inadequate access and circulation of vehicles to <br />the site. <br />2) Inadequate protection and no separation from <br />contiguous nearby residential properties. <br />3) Does not conform to the approved county land use <br />plan. <br />Beginning with the third contention, Director Keating <br />presented staff's position on each of the above issues: <br />3) At the time of the adoption of the Comprehensive <br />Land Use Plan, the site was, and still is, lawfully being <br />55 <br />S E P 191984BOOK 58 F�.,,E 377 <br />
