and be served by a 22 -ft. perimeter belt drive; alignment of <br />certain points in the internal circulation system; and <br />removal of the existing radio tower. <br />Director Keating advised that staff feels that the site <br />plan provides for adequate traffic safety in relation to <br />accessing the development and internal circulation; gives an <br />adequate buffer, even though it is minimal in terms of <br />distance, and the developer has agreed to put in more <br />landscaping than what is required; and that a correct <br />decision was made in relation to the land use and zoning <br />designation given to the site. In light of these <br />conditions, staff recommends that this appeal be denied and <br />that the Planning & Zoning Commission decision be upheld. <br />Chairman Scurlock opened the Public Hearing and asked <br />if anyone wished to be heard in this matter. <br />Ed Luckett, President of the Vista Royale Association, <br />stated he was prepared to talk on all three issues, but will <br />limit it to one. He felt that the WAXE site is a veritable <br />enclave of Vista Royale. It is zoned Medium Density <br />Residential under the Comprehensive Plan and the only <br />private property it touches is Vista Royale. It mystifies <br />the residents how this plan could be approved under the <br />ordinances in effect. The Planning Department has based <br />their conclusion in this matter on the provision in the <br />Comp Plan that states all lawful conforming uses in <br />existence at the date of adoption of the plan will be <br />considered consistent with the plan. <br />Mr. Luckett thought that staff had taken a quantum leap <br />to an illogical conclusion, as every up-to-date zoning map <br />he could find shows this site to be Medium Density <br />Residential, not Commercial. The Association agrees that <br />the property was lawfully used for a radio station at the <br />time the plan was adopted, but opposes a totally different <br />57 <br />SEP 19 1984 BOOK 58 Ft.1,JF379 <br />
