Dear Mr. Scurlock: <br />At the regularly scheduled County Commission meeting held <br />on September 5, 1984, the four Commissioners present at <br />the meeting considered the above request after a public <br />hearing was held. <br />At the time of the public hearing, my office represented <br />Mr. and Mrs. Mannie Holmes who own approximately 8 acres <br />within the acreage which was being rezoned. The Holmes <br />requested at the time of the hearing for the Commission <br />to consider allowing 1.89 acres instead of .8 acres to <br />remain C-1. This request affects the property located <br />in the Northeast corner of the property to be rezoned. <br />The basis for the Holmes -request was that on November 21, <br />1974 the Commissioners approved a Plot Plan for the 1.89 <br />acres for commercial use. There presently exists within <br />this Plot Plan area two buildings, one building houses <br />a gas station operation and convenience store and the other <br />building has from time to time been used for storage purposes, <br />however, presently both are not being utilized. <br />The Commissoner's vote on whether or not to allow 1.89 <br />acres instead of the .8 acres to remain commercial was <br />turned down as a result of a tie vote. On behalf of Mr. and <br />Mrs. Holmes, I would request that the Commissioners reconsider <br />their request to leave 1.89 acres located at the Northeast <br />corner of the property which was rezoned to a C-1 Commercial <br />zoning. The request is based on the fact that the full <br />Commission was not present at the time the vote was taken <br />thereby causing a tie in the ballot. <br />The Holmes would appreciate a consideration of their <br />request at the time a full Commission is present. <br />Very truly yours, <br />,Samuel A. Block <br />David Cairns, attorney representing Mr. & Mrs. Mannie <br />Holmes in the absence of Attorney Samuel Block, explained <br />that his clients were not at home when the rezoning notices <br />were sent out and did not attend the meeting of the Board of <br />County Commissioners of September 5th at which Attorney <br />Block requested that all of the Holmes' property be excluded <br />from the County -initiated rezoning of 17.5 acres to R -2D. <br />At that meeting the request for exemption was denied because <br />of a tie vote of 2-2, and the Holmes' are now requesting <br />that the matter be heard by a full Commission. <br />70 <br />SEP 19 1984 BOOK U8 <br />
