BOOK 58 F�.�E 448 <br />Commissioner Bird wished to know if the site plan for <br />the 17 acres on the southeast side of the intersection is <br />still valid, and if it encompasses the whole 17 acres. <br />Planning Director Keating informed the Board that a <br />site plan for a hotel with a number of independent struc- <br />tures, such as villas, was approved. He believed that it <br />did encompass the entire 17 acres; a building permit was <br />secured and has been kept active. He did tell them, <br />however, that if sufficient construction was not maintained <br />to show a good faith effort, the site plan could be revoked. <br />Attorney Brandenburg believed the it is one of the <br />villas they have started to construct. He confirmed that <br />our new ordinance requires that continuous construction be <br />maintained, and if it is not for a six month period, then <br />the building permit and zoning permit and site plans all <br />expire. This, however, would not preclude them from coming <br />in and asking for an amended site plan to use some of that <br />commercial property for another purpose. <br />Commissioner Wodtke asked when we are going to have our <br />own version of PUD, and Planning Director Keating stated <br />that it still is in workshop. Even after PRD is approved, <br />however, it won't allow a contractual rezoning situation. <br />The way it is structured, it would be a special exception <br />use and you would have to have the underlying zoning in <br />place at the time. <br />Attorney Brandenburg clarified that on a special <br />exception approval, you can place conditions on a project <br />that you cannot normally; you don't actually enter into a <br />contract, but can place your concerns as conditions. <br />Commissioner Bird stated that he had mixed feelings. <br />He sympathized with the residents of Summerplace, and after <br />spending six years on the Planning & Zoning Commission and <br />four years on the County Commission, he was very aware that <br />we have not wanted a prokliferation of commercial on the <br />34 <br />
