F_ <br />BOOK 58 P.vF.784 <br />Attorney Brandenburg suggested that the last sentence in the <br />letter staff is proposing to send out, which says that no con- <br />struction may occur, be scrapped and instead just make everyone <br />aware of the fact that they are required to get County approval <br />to do anything out there. <br />Commissioner Wodtke asked if, in other words, he wanted the <br />Board to make a Motion more or less stating that we are going to <br />overlook the zoning violations, and Commissioner Bird, felt that <br />basically we have said we are in the process of having our <br />consultant draw up a zoning code that is going to grandfather in <br />the existing situation, and he felt it would be contradictory to <br />that to be running out there citing zoning violations. <br />Attorney Brandenburg suggested that perhaps the letter can <br />say there are zoning violations under our current ordinance; that <br />the County is moving to adopt a new one and has opted not to use <br />the enforcement option at this point with respect to the current <br />ordinance. The future ordinance in all likelihood will <br />grandfather in all existing structures and and require all <br />individuals planning future construction or activity in the area <br />to come in and be permitted. <br />Administrator Wright felt that was fine, but what happens in <br />the interim. <br />Attorney Brandenburg noted that in the interim, staff is not <br />going to enforce the current zoning code against the individuals <br />who are out there now. <br />Administrator Wright argued that then anyone who wants to <br />build tomorrow can just go out there and start building. The <br />problem he is trying to get at is that people have tended to <br />believe they don't need a permit to build out there. He stressed <br />that he doesn't want to go after anything that is existing. <br />MOTION WAS MADE by Commissioner Wodtke, SECONDED <br />by Commissioner Bowman, to authorize the proposed <br />letter to be sent to Blue Cypress area residents by <br />38 <br />_I <br />
