AN AGREEMENT BETWEEN INDIAN RIVER <br />COUNTY, FLORIDA, AND THE CITY OF VERO <br />BEACH, FLORIDA, TRANSFERRING THE <br />RESPONSIBILITY FOR PROVIDING WATER <br />SERVICE TO THE SOUTH BEACH AREA FROM <br />THE COUNTY TO THE CITY OF VERO BEACH, <br />FLORIDA. <br />THIS AGREEMENT, entered into this 21st day of November 1984, by and <br />between Indian River County, a political subdivision of the State of Florida, <br />address 1840 25th Street, Vero Beach, Florida 32960, and the City of Vero Beach, a <br />municipal corporation organized under the laws of the State of Florida, address <br />P.O. Box 1389, Vero Beach, Florida 32961-1389, <br />WITNESSETH: <br />WHEREAS, the Board • of County Commissioners of Indian River County, <br />Florida, at its October 17, 1984 regularly scheduled meeting reached the conclusion <br />that it was not economically feasible to serve the South Beach area with the <br />County's water supply, as envisioned by an agreement with the City dated <br />September 16, 1981, and <br />WHEREAS, the County by letter dated October 16, 1984, elected to return <br />certain water provision responsibility to the City pursuant to paragraph 12 of the <br />referenced agreement, and <br />WHEREAS, the County in that letter also suggested that the City provide water <br />service to the entire South Beach area, from the city limits to the south county <br />line, and <br />WHEREAS, the City Council of Vero Beach at a public meeting on November 7, <br />1984, offered to accept the entire South Beach area from the south city limits to the <br />county line as the permanent and exclusive service territory of the City for the <br />provision of water, and <br />WHEREAS, the County by this Agreement accepts the offer of the City of <br />November 7, 1984, as set forth above, and <br />WHEREAS, it is recognized that this transfer of rights to the City will require <br />the City to make substantial capital outlays, and <br />WHEREAS, in consideration of these outlays the rights granted herein by the <br />County are permanent, exclusive, and contractual, <br />NOW THEREFORE, for and in consideration of the mutual covenants of this <br />agreement the County and City agree as follows: <br />W <br />NOV 21 1994 <br />.A <br />
