s � � <br />dwelling. When this application was submitted to the Building <br />Dept., it was called a townhouse. After reviewing it as a <br />townhouse, they found that it did not meet the construction <br />requirements because it needed to have a fire wall separation <br />between the units. Her assistant, who reviewed the plan, called <br />either Mr. Mitchell or the engineer who developed the plan, and <br />told them that it did not meet townhouse construction requirements, <br />and was informed by the owner that he did not want to go to this <br />expense and that the units would be built as a condominium. <br />Staff took special care when they wrote the permit for a condo- <br />minium so there would be no misunderstanding. <br />Attorney Brandenburg advised that the owners would -have to <br />change the form of their documents, but they still would have to <br />replat if they go to a condominium. He confirmed that any time <br />you transfer a certain portion of the land with the unit, you are <br />into a land condominium and must go through these platting <br />procedures. There is a variance procedure in the subdivision <br />code with respect to platting, but he did not believe there was a <br />variance procedure for the building requirement of a fire wall. <br />Attorney Brandenburg stated that the situation could be resolved <br />by the Board approving the vacation of plat and requiring the <br />owner to replat it as a land condominium and to do whatever is <br />necessary to get their ownership documents off the record and go <br />through a condominium association. <br />Attorney Bogosian believed that if they go as a straight <br />condominium, rather than a land condominium, and have all the <br />area surrounding and underneath the units as common area, then <br />they would not have to replat. Attorney Brandenburg confirmed <br />this, but advised that they would still need to vacate this plat. <br />Commissioner Wodtke was concerned about the sewer permit <br />situation, and Mike Galanis of the Environmental Health Dept. <br />advised that he cannot issue any more permits if this is to be a <br />condominium association, the DER then would require a treatment <br />plant. <br />43 <br />NOV 28 1984 BOOK . 59 mE 43 <br />
