DeB lois,AICP <br /> Chief, Environmental Planning <br /> &Code Enforcement <br /> FROM: Kelly Buck <br /> Code Enforcement Officer <br /> DATE: September 14, 2015 <br /> RE: Amy Honey's Request for Partial Release of an Easement at 1415 Sunset Point Lane <br /> (Sunset Point Subdivision) <br /> It is requested that the Board of County Commissioners formally consider the following information at <br /> the Board's regular meeting on September 22, 2015. <br /> DESCRIPTION AND CONDITIONS <br /> The County has been petitioned by Amy Honey, owner of two combined lots (Lots 6 and 7) at 1415 <br /> Sunset Point Lane in Sunset Point Subdivision (now known as Sunset Lagoon), for release of the north 5 <br /> feet of a 20 foot drainage and pedestrian access easement on Lot 6. The purpose of the easement release <br /> request is to eliminate the pedestrian access portion of the easement which is now unnecessary since the <br /> two lots have been combined and pedestrian access between Lots 6 and 7 is no longer needed. This <br /> partial easement release is requested to accomodate planned improvements on the combined lots (see <br /> attached maps). <br /> ANALYSIS <br /> The request has been reviewed by the County Road&Bridge and Engineering Divisions;the County <br /> Surveyor;the County Planning Division; and the Sunset Lagoon Property Owners Association.None of <br /> the reviewing agencies expressed an objection to the requested partial release of easement. Therefore, it <br /> is staff's position that the requested partial easement release would have no adverse impact to drainage <br /> or pedestrian access to the subject property or to other properties, since no objections have been raised <br /> and since pedestrian access between Lots 6 and 7 is no longer necessary. <br /> RECOMMENDATION <br /> Staff recommends that the Board,through adoption of the attached resolution, approve partial release of <br /> the drainage and pedestrian access easement described in the resolution. <br /> 125 <br />
