At this time, the applicants request that the subject alley right-of-way be abandoned. <br /> ANALYSIS: <br /> Consistent with guidelines established by the Board of County Commissioners, this petition was <br /> reviewed by all County divisions and utility providers having jurisdiction orpotential interests within <br /> the subject 10' wide alley right-of-way. Upon review, several reviewing departments and agencies <br /> indicated that they did not support the request for abandonment,without a replacement drainage and <br /> utility easement dedicated by the applicants. Subsequently,a 10' wide drainage and utility easement <br /> was dedicated along the southern 10' of lots 4-5 to create the replacement easement, and all <br /> reviewing departments and agencies now support the request for abandonment. It should be noted <br /> that there were several plat-dedicated side and rear lot drainage and utility easements along the <br /> boundaries of the subject lots.Those easements have been released by all reviewing departments,in <br /> accordance with the LDRs. <br /> As noted on the County Thoroughfare Plan,the subject alley right-of-way is not part of the County's <br /> major roadway system and is not needed for the thoroughfare system or for traffic circulation in the <br /> surrounding neighborhood. In this case, the subject alley does not provide primary access to any <br /> property, and is too narrow for two-way traffic. Since each lot adjacent to the alley has adequate <br /> frontage on a local street or thoroughfare road, the abandonment will not affect the right of <br /> convenient access to any surrounding properties. Also,the County Attorney's Office has reviewed <br /> and approved the attached abandonment resolution for legal form and sufficiency. <br /> RECOMMENDATION: <br /> Based on the analysis,staff recommends that the Board of County Commissioners abandon its rights <br /> to the subject alley right-of-way and authorize the chairman to execute the attached abandonment <br /> resolution. <br /> ATTACHMENTS: <br /> 1.
