Baird, County Administrator <br /> DEPARTMENT HEAD CONCURRENCE <br /> Stan Boling, Ali ; Community Development Director <br /> FROM: Sasan Rohani, AICP, Chief, Long-Range Planning <br /> DATE: September 8,2015 <br /> RE: Orchid Quay,LLC;Request to Rezone f 41.95 Acres Located East of US#1 and <br /> .North of 82°d Street from CG, General Commercial District, to OCR, Office, <br /> Commercial, Residential District(99070005) <br /> It is requested that the following information be given formal consideration by the Board of County <br /> Commissioners at its regular meeting of September 22, 2015. <br /> DESCRIPTION AND CONDITIONS <br /> This is a request by Orchid Quay, LLC to rezone f 41.95 acres, located east of US #1 and north of <br /> 82nd Street from CG, General Commercial District, to OCR, Office, Commercial, Residential <br /> District. The subject 41.95 acre property consists of three parcels(28.33 acres,8.77 acres,and 4.85 <br /> acres). The purpose of this rezoning request is to enable development of the site with either <br /> residential uses or commercial uses as allowed under the OCR zoning district regulations,including <br /> stand-alone residential, office, and a restricted number of commercial use categories. <br /> The subject property is part of a larger parent property owned by the applicant.At its regular meeting <br /> of March 23, 2006 the Planning and Zoning Commission granted major site plan approval to <br /> Institutional Housing Partners(previous owner)to construct 499 residential multi-family units on the <br /> larger parent property which includes the subject site,and some surrounding parcels that are not part <br /> of this rezoning request. Subsequently, development of horizontal infrastructure improvements <br /> (roads,utilities,drainage)commenced on the larger parent property in accordance with the approved <br /> site plan. Construction activities ceased a few years ago,during the economic down turn.Although <br /> there are no buildings on the site,the site plan approval continues to remain valid because substantial <br /> project construction commenced. The proposed rezoning from CG to OCR will be consistent with <br /> the approved site plan. <br /> In 2012, Orchid Quay, LLC, requested a future land use map designation swap to designate 28.33 <br /> acres of its property located near US#1 as Commercial/Industrial (C/I) and to rezone that property <br /> from RM-6, Multi-Family Residential District, up to 6 units per acre,to CG.
