Mr. DeBlois stated staffs position was there was sufficient evidence and direct <br /> testimony under oath from the person who took the photos, with corroborating <br /> information from Mr. Herren, that light was visible from the beach when the drapes <br /> were open on the third floor of the subject property. He added it was also staff s <br /> position if the light could be seen from the beach it would mean the window faced <br /> the ocean, and recommended the Board uphold the citation. <br /> 12:02:29 <br /> ON MOTION BY Mr. Gervasio, SECONDED BY Mr. <br /> Petrulak, the members voted (4-2) to rescind the fine <br /> and not to uphold Citation #2014100110.
