Orchid Quay, LLC; Request to Rezone t 41.95 Acres Locate ast <br /> of US #1 and North of 82nd Street from CG, General C mercial <br /> District, to OCR, Office, Commercial, Residential Dist r' (99070005) <br /> [Quasi-Judicial] <br /> Chairman Polackwich understood staff had re ved a request from the <br /> applicant to postpone this matter until August 1 015, as per a letter dated <br /> June 10, 2015 on file in the Commission Offic ; owever he decided to open the <br /> public hearing and vote on the matter. <br /> Chairman Polackwich opene a public hearing at 7:02 p.m. <br /> ON MOTION Mr. Brognano, SECONDED BY Mr. <br /> Stewart, members voted unanimously (4-0) to <br /> poste a the public hearing for Orchid Quay, LLC's <br /> R est for Rezoning until the August 13, 2015, <br /> :00 p.m. Planning & Zoning Commission meeting. <br /> The public hearing was closed at 7:03 p.m. <br /> Chairman Polackwich read the following into the record: <br /> —� B. Consideration of Proposed Amendments to County Sea Turtle <br /> Protection Lighting Regulations (Land Development Regulations <br /> Section 901 .03, Definitions, and Section 932.09, Sea Turtle <br /> Protection) [Legislative] <br /> Mr. Roland DeBlois, IRC Chief, Environmental Planning & Code <br /> Enforcement, reviewed the information contained in his memorandum dated <br /> June 4, 2015 and gave a PowerPoint presentation, copies of which are on file in <br /> the Commission Office. He related the Board of County Commissioners (BCC) <br /> had directed staff to draft an ordinance amending Land Development Regulation <br /> (LDR) Section 932.09 pertaining to sea turtle protection lighting restrictions; and <br /> further recommended that the area of restricted illumination be extended beyond <br /> the beach to-include dune areas. <br /> Mr. DeBlois compared the County's current ordinance with those of local <br /> jurisdictions and counties and the State model, and noted the proposed language <br /> revising the County's LDR definition of "illuminate" would be to eliminate the <br /> "visible from two feet or less in height" and replace it with "visible to an observer i <br /> on the beach".
